1 ) SALE OFFER
a) When you place an ‘offer to purchase goods or services’ (order) by completing and submitting an electronic order for any material, product (in this agreement ‘products’), or electronic registration of a delegate at an event or conference (in this agreement ‘events’) by submitting a completed order request, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract with us. Your contract with us will only commence when we, RZIM Europe, confirm acceptance of your order by email or by letter. We will then agree to supply the products listed on the order. You will still receive an automatic confirmation that your offer to purchase (order) has been received and that the order is being processed.
b) Any advice or recommendations given by any representative of RZIM Europe to the buyer relating to products, which is not confirmed in writing by RZIM Europe, will not be binding on RZIM Europe.
c) Any variation to these terms and conditions will be posted on the website.
d) Throughout the website and ordering process and in all correspondence we use the English Language. No other languages are available on this website.
2 ) ORDERING
a) In submitting an order the buyer acknowledges that:
b) All information and specifications relating to the products produced by a publisher are approximate and all errors on the website may be corrected without any liability to RZIM Europe. The design on the product covers or sleeves may vary from those supplied because of monitor and printer capabilities and last minute changes made by publishers.
c) RZIM Europe may make any changes to the specification of the resources to conform to any statutory or European requirements.
3 ) RIGHT OF WITHDRAWAL
a) The buyer has the right to withdraw from the contract within 7 working days of submitting the order for the products by giving written notice of withdrawal and RZIM Europe shall credit the buyer’s card for the price of the products withdrawn. This will include any charges made against small orders and any postage charge levied.
4 ) PRICING POLICY
a) The price of the products shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by RZIM Zacharias Trust. A confirmed buying price will be sent to you when we have accepted your order by e-mail or letter.
b) The price of the products may not include the cost of delivery to destinations outside of the United Kingdom. For such orders, the Buyer will pay the delivery charge as quoted on the website on the day of purchase.
c) The price of the products includes any applicable Value Added Tax (VAT), which the buyer shall be liable to pay RZIM Zacharias Trust.
d) All prices quoted on RZIM Europe are inclusive of VAT unless stated otherwise.
5 ) CREDIT CARDS
a) Credit and Debit cards accepted by RZIM Europe are listed on the website.
b) All charges to credit/debit cards will be made at the time the goods are ordered, and pending stock status these charges will be applied at the point of dispatch. Any fraudulent use of Credit/Debit cards will be notified to the authorities along with any identification details that were supplied with the order.
c) Any refund made to the Buyer’s credit or debit card shall be subject to the Terms and Conditions of the Issuing Bank and therefore be subject to any time delay as specified by the Issuing Bank. No liability shall be placed on RZIM Europe for any delay that is outside of their control. A correct cardholder name and address must be supplied with every order if it is different to the buyer’s.
d) All accepted orders will be processed by RZIM Zacharias Trust, 97a St Aldates, Oxford, Oxfordshire, OX1 1BT, United Kingdom. Tel: 01865 203951 registered in England and Wales with Company Number: 3449676. We will debit your payment card for these goods and our name will appear on your statement against the purchase.
e) Our payment service provider SagePay utilises CV2 verification. CV2 stands for Card Verification Value. The CV2 numbers is a 3 digit number printed (not embossed) on the back of your card over the signature strip. It helps protect against credit card theft by individuals who do not possess the physical card.
f) If you are a UK resident using a UK issued card for a transaction over £100 you are automatically protected by Section 75 of the Consumer Credit Act 1974.
6 ) DELIVERY
a) If the buyer does not take delivery of the products or give RZIM Europe adequate delivery instructions then no duty of care shall apply, any loss or damage or deterioration to the products shall not render RZIM Europe liable.
b) If the buyer does not receive all the goods as specified on the original order then the buyer must notify RZIM Europe in writing within 14 working days from the date of delivery. If the buyer does not inform RZIM Europe in writing within the specified time then no liability will be attached to RZIM Europe. In any event any loss or damage suffered by the buyer as a result of such a delivery shall be limited to the price of the goods not delivered or the cost of replacement products.
c) Risk of damage or loss of the products shall pass to the Buyer on delivery or, if the Buyer fails to take delivery of the Goods, the time when the Supplier has tried to deliver the Goods.
d) Title shall pass to the buyer on delivery of the goods.
7 ) WARRANTY AND OWNERSHIP
a) Subject to the conditions set out below RZIM Zacharias Trust warrants that the products will correspond with the order at the time of delivery and will be free from defects on delivery. If RZIM Zacharias Trust is in breach of this warranty the buyer shall notify RZIM Europe within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty RZIM Zacharias Trust may, at its sole option either replace all the faulty products or refund the price of the products that are defective. This shall be the extent of the liability of RZIM Europe and no consequential loss claim of any kind shall be made against RZIM Zacharias Trust.
b) If you are returning an item because of an error on our part or because it is defective, we will be happy to refund the delivery charges incurred in sending the item to you and your postal costs in returning it to us. Where you are withdrawing from your purchase within the seven working days cooling-off period, we will also refund the normal postage charge for the delivery of that item but we cannot refund any priority, express or courier component of the delivery charge. You will be responsible for those charges and the costs of any other services provided to you in connection with your purchase, for example giftwrapping.
8 ) YOUR STATUTORY RIGHTS
a) At RZIM Europe we want you to be happy every time you shop with us. Occasionally though, we know you may want to return items. That’s why under our guarantee if, for any reason you are unhappy with your purchase, you can return it to us in its original condition within 14 days of the date you received the item.
b) By law, you also have the right to withdraw from your purchase of an item within seven working days of the day after the date the item is delivered to you. This applies to all of our products except for where the item has been downloaded.
c) To cancel your purchase under this 7 day cooling-off period, please put a note in with your product explaining the reason for the return as “contract cancellation”. Please package the relevant item securely and send it to us with the delivery slip so that we receive it within seven working days of the day after the date that the item was delivered to you. d) For your protection, we recommend that you use a recorded-delivery service when returning products.
e) Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error, or if the item is faulty. As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item’s normal delivery charge, we cannot refund any priority, express or courier component of the postage charge. 9 ) EVENT TERMS & CONDITIONS
a) Your registration is not confirmed until the deposit has been received.
b) Delegate places can only be exchanged like-for-like (i.e. adult single room for adult single room) and must be submitted in writing.
c) RZIM Europe recommend personal holiday insurance should be purchased in case of late unforeseen circumstances.
d) No pets are allowed on-site at an event except guide dogs.
e) Every care is taken to ensure that the speakers, lecture titles, locations, and timings are accurate. However, RZIM Zacharias Trust reserve the right to make amendments to the programme if necessary, and in the case of unforeseen circumstances, may alter any of these details.
f) Attendance at an RZIM Europe event implies permission for RZIM to reproduce your image, likeness, and voice on reproduced audio and visual recordings, and publicity material.
g) RZIM Europe will seek to acquire written or verbal authorisation when using written quotations submitted by delegates on event feedback forms
h) Where age restrictions are indicated during registration, they must be adhered to. Failure to comply with such restrictions may result in your place being cancelled according to our Refunds & Cancellations policy for the event.
i) Where a preference for a specific seminar or group session is requested during registration, we make every attempt to allocate delegates to this preferred first choice. However, when popular sessions mean bookings exceed the maximum number of spaces for a venue, or indeed where delegates wish to change streams during an event, it may not be possible for us to accommodate such preferences, and in these cases we reserve the right to reject the request. While making every effort to accommodate a request, each case will be processed on a first come first served basis.
10 ) PRIVACY & SECURITY
a) RZIM Europe ensures that the identity of anyone who contacts us through this website is kept confidential. Any form that requests personal financial information, whether it is a product order through our online bookstore, an event registration, a donation, or any other on-line transaction is handled in the most secure way possible. The pages where your information is entered are kept on a secure server and only an authorised staff member can access the information for processing.
b) Any personal data that is collected, processed, stored or transmitted is handled with integrity and in accordance with the Data Protection Act 1998, our Data Protection Registration Number is Z9366865.
c) RZIM Europe acknowledges that personal information collected, processed, stored or transmitted must be regulated and handled with integrity. In respect of RZIM Europe we have ensured that technical and organisational measures have been put in place against accidental or unlawful destruction, alteration, disclosure or access to personal data.
d) We do not share the information we collect about you outside of the RZIM International organisation. We employ other companies and individuals to perform functions on our behalf. An example of this is SagePay our payment service provider. SagePay process our credit card payments. They have access to personal information to perform their functions but are bound by the Data Protection Act 1998 and are therefore not allowed to use the information for any other purpose except for processing payment.
11 ) EXPORT TERMS
a) RZIM Europe will be responsible for complying with any legislation or regulation governing the importation of products into the Country of destination.
b) Many countries charge duty on goods at the point of import, these will normally be collected by the courier used to deliver your goods – this is a charge levied by your government not by RZIM Zacharias Trust and we have no control over it.
12 ) WITHDRAWAL OF GOODS
a) RZIM Europe may withdraw the sale or distribution of any products produced by or generally supplied by RZIM Zacharias Trust without prior notice, or liability, to the Buyer.
13 ) COURT JURISDICTION
a) The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts. These Terms and Conditions are also in line with The Consumer Protection (Distance Selling) Regulations 2000 and the EU Distance Sales Directive of 1998 and the Privacy and Electronic Communications Regulations 2003.
